4017 Bayside Open Studio’s Terms & Conditions

  •  4017 Bayside Open Studios will operate over two weekends 14/15 and 21/22 Oct 2023, during the core hours of 10am to 4pm each day. It is expected that artists will participate during that period and the core hours keeping their studios open for visitors during those times as advertised in the Studio Guide. Studios can also choose to open during the week,
  • All participants MUST be a financial member of Sandgate Art Society, Inc for 2023. Individual membership is $36 per annum. All are welcome to join the Sandgate Art Society Inc (SAS) regardless of their place of residence or studio location. This is mandatory for Insurance coverage participation in 4017 BOS.
  • All participants (whether an individual artist in your own space, sharing a studio or a group/gallery) are subject to the participation fee of $100 for inclusion in Open Studios. If the participants are found to have contravened this condition, the committee may ask the participant to cease their exhibition.
  • Artists or community groups may opt to have a full A5 page in the Studio Guide for $200. You may indicate this at payment.
  • Inclusion in 4017 Bayside Open Studios is subject to artists supplying all appropriate images requested, completed application form, and paid fees by the due date if not before. Successful applicants will be notified by as soon after the due date of submission of applications as possible, 30th June 2023.
  • Your $100 participation fee covers your half A5 page feature listing in the Studio Guide which helps promote your studio and you as an artist for this high-profile event. This guide will have a distribution of approximately 3000. As well, there will be considerable social media online presence for the event.
  • All artwork displayed (for sale or otherwise) must be the original work of the artist and be presented in a professional and clean condition.
  • Participants must be always present in their studio and exercise professional conduct during the program. They will actively promote 4017 Bayside Open Studios, Sandgate Art Society Inc, Open Studios Sponsors and the other artists and studios included in the 2023 program.
  • The committee requests for safety reasons that each studio has 2 people present at all times. whether it is 2 participating artists or 1 artist and a support person.
  • Participants will facilitate a health and safety inspection of their studio space and have a COVID Safety Plan in place if required by the State Gov at the time of the event.
  • Each participant will be expected to perform an organisational task as requested by the Open Studio Committee.
  • All artist participants and studios will be asked to report statistical details regarding visits to their studio, sales, etc at the completion of the Open Studios as required by our Grants applications terms. Any of this data collected will be kept strictly confidential and only passed on in non-identifiable, summary form to the council. 

Copyright Agreements: 

SCOPE

This licence agreement covers all written content and photographs supplied by the artist to the publisher as part of the artist’s participation or involvement in the 4017 Bayside Open Studios. Photographs and written content are referred to as materials and Sandgate Art Society Inc as ‘The Publisher’. 

ASSERTION

The artist certifies that they are the owner of copyright of the materials and that they permit the publisher to use them for the purposes of promoting the 2023 4017 Bayside Open Studios. The artist agrees that he/she will be fully liable should any copyright infringement be claimed or discovered subsequent to the agreement. The artist also certifies that they have obtained a model release (if required) for any person or persons depicted in any photographs. 

RIGHTS

The artist grants the publisher the nonexclusive right to use, reuse, and republish the materials in print and digital formats for the purpose of promoting Sandgate Art Society Inc or the artist for the duration of the 2023 Open Studios event. The right includes the right to incorporate the materials into other pre-existing compositions and to use the materials in future compositions for a period of no more than 12 months. 

ALTERATIONS

The artist agrees to allow the publisher the right to edit and/or modify the materials: 

  • To correct factual, grammatical, syntax, spelling and punctuation errors. 
  • To remove any material that encourages terrorism, sexism, religious or racial hate or criminal activity.
  • To ensure technical suitability for print publication and digital formats.
